What are Private Prosecutions?
While most criminal cases are handled by the Crown Prosecution Service or other state bodies like the Serious Fraud Office, Financial Conduct Authority, or Health and Safety Executive, our team of experts specializes in private prosecutions, helping you seek justice where state authorities have failed.
Under section 6 of the Prosecution of Offences Act 1985, any person or company can initiate a private prosecution for criminal offences from financial offenses to serious assaults.
The Crown Prosecution Service is a fairly new phenomenon. Before they were created in the 1980’s prosecutions were mostly a mixture of private prosecutions and those brought by the Police services.
Nowadays, many people who complain about a criminal offence being committed against themselves, their family, or their company, are disappointed as the offences against them do not end up properly investigated or prosecuted.
All prosecutions, whether they lead to trial in the magistrates’ court before a District Judge or lay bench (voluntary magistrates) or a trial in the Crown Court before a jury, including private prosecutions, are commenced by the laying of an information.
That information, along with the evidence submitted along with it, is then considered by the Magistrates’ Court that receives them, and if deemed appropriate, a summons is issued which requires the defendant to attend court and answer the charge.
